AGREEMENT ----Mutual Assurance Society Records, Misc Records 1794-1869, Virginia State Archives, Richmond, Virginia Articles of agreement entered into this 24th of Sept 1846 between Parnell & Howle of the one part and Alexr H. Rutherfoord of the other part--- The said Parnell & Howle hereby engage to build for the Said Alexr H. Rutherfoord a Dwelling House on Grace Street to be twenty six feet Front in all & thirty nine feet in depth out to out, and to be constructed as herein after mentioned-- The Basement Story is to be eight feet Pitch in the clear, three feet below the Surface of the ground, the outside walls to be one & a half Brick thick & the Dividing Walls to be only one Brick thick & the interior walls to be carried up no higher than to the top of the Basement Story-- One room in the Basement intended for a Kitchen to be floored with hard Bricks & the fire place constructed for Burning wood-- The first or principal Story to be Eleven feet Pitch in the clear, the walls one & a half Bricks thick-- The Second Story to be Ten feet Pitch in the clear & the walls the Same thickness as in the Story below-- There Shall also be an Attic or Upper Story to be eight feet Pitch & finished off on the Gable ends in the same manner as in the House lately erected by John C. Hobson on 5th Street, walls Similar to those below-- The whole Building from bottom to top to be built with good hard Bricks & to be faced with Stock Bricks from the Surface of the ground to the top on the Front-- The Bricks Lime & workmanship to be of the best description--The said Parnell & Howle hereby farther engage that the whole work to be done on their part shall be finished by the fifteenth day of November next at farthest-- In consideration of the foregoing agreement on the part of the of the said Parnell & Howle the Said Alexr H. Rutherfoord hereby agrees to pay unto the Said Parnell & Howle, for the building at the rate of Eight Dollars and a half pr thousand for the Bricks in the said Building, according to the usual measurement and for Pavement at the rate of fifty cents pr square yard & for setting Grates according to the usual rates now given for such work--- The payments to be made as follows: The said Alexr H. Rutherfoord hereby engages to convey unto the said Parnell & Howle a right in Fee Simple to a lot on Clay Street, Viz: being thirty feet front on said street and running back one hundred & forty feet deep to an alley and designated by the number eight in a plan of lots drawn by John Rutherfoord dated 16th May 1845. Said lot No. 8 being at the junction of Clay Street with a street separating it from the property of Mr. A. Dill, as will more fully appear on reference to the said plan which will be found recorded in the Hustings Court of the City of Richmond with a deed from the said John Rutherfoord and wife conveying lot No. one in said plan to Francis H. Deane and other dated 17th May 1845--at the price of five hundred & fifty dollars, and to pay in cash soon as the whole work is finished to the said Parnell & Howle any balance the said work may amount to over and above what the lot to be conveyed shall amount to--- For the true performance of the Stipulations contained in this Agreement, We the Parties bind ourselves under Penalty of One Thousand Dollars.
